1. General Provisions

1.2. The Service provides information about external platforms (referred to as “External Platforms”) that enable trading (referred to as “Services”).
1.3. These terms of service (referred to as the “Terms”) govern your (“You”, “Your” or “User”) use of the Service and related Services. We encourage you to read the Terms carefully before using the Services. By using the Service you accept the Terms, which form a legally binding agreement between you and the operator of the Service. If you do not accept the Terms, stop using the Service immediately. The Terms may be updated from time to time.

2. Requirements
2.1. You may use the Service only if you meet the following conditions:
2.1.1. You are at least 18 years old;
2.1.2. You have legal capacity, authority and the ability to enter into this agreement and to comply with all conditions contained in it;
2.1.3. You are not prohibited from using the Service and/or Services under the laws applicable in the country where you reside or are located at the time of accessing the Service.
2.2. Goldfield Monshore makes no warranties, express or implied, regarding the legality of the Service and/or Services, nor regarding how individual persons choose to use them. We are not responsible for unauthorised use of the Service and/or Services.
3. Restricted Territories
3.1. Goldfield Monshore reserves the right, in its sole discretion, to restrict access to the Service and/or Services (or parts thereof) for: (i) users from specified areas (referred to as “Restricted Territories”) and (ii) persons for whom there is reasonable belief that they may create legal, regulatory, reputational or financial risk.
3.2. We may impose additional conditions or requirements before accepting users who reside in or come from certain countries. If a user travels to a Restricted Territory, access to the Service and/or Services may be limited or blocked.
4. Prohibited Conduct
4.1. You agree to use the Service and Services in a lawful manner and refrain from:
4.1.1. Creating links to the Service and/or using the Service to transmit, download, distribute, publish or send (a) information or materials that infringe intellectual property, privacy or other rights; (b) content that is unlawful, threatening, abusive, defamatory, racist or otherwise inappropriate; (c) content containing viruses or other software that may damage our systems or third-party systems; (d) content that violates applicable laws; or (e) content containing advertising without our written consent.
4.1.2. Removing or modifying legal information or proprietary markings in the Service;
4.1.3. Accessing the Services through interfaces other than the Service;
4.1.4. Interfering with other users’ use of the Service and/or Services;
4.1.5. Using robots or automated systems to interact with the Service and/or Services;
4.1.6. Transmitting or sending (or attempting to send), without our consent, materials that constitute hidden data collection tools or tracking technologies (e.g. web bugs, cookies or spyware);
4.1.7. Using “framing”, “mirroring” or other unauthorised copying of the appearance or functionality of the Services;
4.1.8. Violating applicable laws or encouraging unlawful conduct, including but not limited to infringement of copyright, trademarks, defamation, identity theft, hacking or distribution of illegal software;
4.1.9. Modifying or manipulating the source code of the Service or transmitting software that may harm the Service or third parties;
4.1.10. Decompiling, disassembling or reverse engineering the software or technology used in the Service or Services.
4.2. You acknowledge that if we determine you are using the Service or Services in a manner contrary to these Terms or applicable law, we may monitor your use, restrict access, share information about your activity with third parties and take any actions we deem necessary to protect our rights and interests and those of third parties.
5. Intellectual Property
5.1. The entire Service, including all content such as videos, text, graphics, logos, designs, music, sounds, characters, trademarks and other materials, is protected by intellectual property rights owned by us or third parties.
5.2. We own all rights, title and interest in the Service and Services. Use of the Service or Services does not grant the User any intellectual property rights, other than the limited right of use arising from these Terms.
5.3. Users may use the Service and Services only for personal, non-commercial purposes.
5.4. Users are prohibited from modifying, decompiling, disassembling, reverse engineering, copying, transmitting, creating derivative works, renting, sublicensing, distributing, reproducing, republicating, scraping, downloading, displaying, transmitting, publishing, selling or otherwise using the content of the Service without our express written consent. This prohibition includes any use that is inconsistent with the Terms or constitutes unauthorised use of the content.
6. Limitation of Liability
6.1. You use the Service and/or Services at your own risk. To the extent permitted by law we disclaim all liability and warranties, both express and implied, related to the Service and Services, including warranties of merchantability, title, fitness for a particular purpose, non-infringement, usefulness, accuracy, completeness and currency. The Service and Services are therefore provided “as is”, “as available” and “with all faults”.
6.2. Without limiting the foregoing, we are not liable for (a) errors, inaccuracies or omissions in the content of the Service; (b) interruptions or disruptions in transmission to or from the Service via the Services; (c) viruses, trojans or similar malicious software that may be transmitted by third parties through the Service or Services.
6.3. You agree to release us from liability for any losses suffered by you or third parties, directly or indirectly, in connection with the Service and/or Services. You bear full responsibility for all decisions made on the basis of the content of the Service and/or Services.
6.4. In no event shall we be liable for special, direct, indirect, incidental, punitive or consequential damages, including loss of profits or data, arising from the use of the Service and/or Services or downloading materials from the Service. This applies regardless of whether liability is based on warranty, contract, tort or other legal basis, and regardless of whether we have been advised of the possibility of such damages. If a court finds us liable, our liability shall not exceed 100 USD. This limitation applies to the extent permitted by law.
6.5. We are not liable for technical problems or failures of telephone lines or networks, computer systems, servers, providers, hardware, software or disruptions caused by internet traffic load or incompatibility of the Service/Services with your browser or hardware. We disclaim all liability related to your use of the Internet.
7. Third-Party Services and Content
7.1. While using the Services you may encounter content or services of third parties, such as advertisements or descriptions of External Platforms.
7.2. We do not control or endorse such content or services — they may be inaccurate or outdated.
7.3. We recommend that you verify information independently before relying on it. Any decisions or actions taken on the basis of such information are at your own risk.
8. Links
8.1. The Service may contain links, content, advertisements, promotions, logos and other materials from external websites or software (referred to as “Links”). We draw your attention to the risks associated with using such websites, programs or materials before downloading, using, relying on or purchasing through them. Links are provided solely for your convenience and you agree not to hold us liable for any losses or damages resulting from use of or reliance on content, goods or services from such websites or programs.
8.2. The inclusion of links in the Service does not imply any approval, authorisation, sponsorship, affiliation or other connection between Goldfield Monshore and such external websites, programs or their operators.
8.3. We have not reviewed all such links and are not responsible for the content of the websites or programs they lead to. We recommend that you always assess the risks before accessing, using, relying on or purchasing through them. Goldfield Monshore is not liable for any losses or damages resulting from such use.
8.4. It is your responsibility to familiarise yourself with the terms and conditions of such external websites, and we strongly recommend that you read them carefully before interacting with third parties.
9. Miscellaneous Provisions
9.1. We may, in our sole discretion, modify, adapt or discontinue parts or all of the Services, and introduce new Services at any time. We are not liable for any losses incurred as a result of such changes and you may not direct any claims in this regard to Goldfield Monshore.
9.2. We reserve the right to update these Terms periodically. After an update we will publish the latest version and update the date at the top of the page. Changes take effect immediately upon publication. By continuing to use the Service after changes are introduced, you accept the updated Terms.
9.3. The User acknowledges that transmitting information to or from the Service does not establish any relationship other than that specified in these Terms.
9.4. These Terms and the Privacy Policy, in their currently applicable versions, constitute the only valid agreement between Goldfield Monshore and the User. No promises, agreements or understandings, oral or written, beyond their content shall be legally binding.
9.5. Our failure to enforce any right, power or remedy at any given time does not constitute a waiver of the right to exercise it in the future. Partial exercise of a right does not preclude its full exercise.
9.6. If any provision of these Terms is held invalid or unenforceable by a competent court, it shall be severed without affecting the validity of the remaining provisions. The Terms shall be interpreted in a manner that best reflects the original intent underlying the provision, to the extent permitted by law.
9.7. We reserve the right to transfer or assign all our rights and obligations arising from these Terms to a third party. The Service and/or Services may also be operated by a third party. You have no right to transfer, assign or encumber any of your rights or obligations under these Terms in any way.
